The services provided by Fresh Laundries that has accepted and processed your order are subject to your (“Customer”) compliance with and acceptance of the terms and conditions set forth below.
Please read the following agreement carefully. The use of any Fresh Laundries services by the “Customer” indicates an agreement to be bound by the terms and conditions outlined herein.
This agreement is strictly between Fresh Laundries and the Customer and does not in any way constitute or imply any relationship with any other parties. As a condition of using any of Fresh Laundries’ services, and for the mutual benefit of both Fresh Laundries and the Customer, the undersigned (“Customer”) agrees to the following terms and conditions:
Garment Care, Holding Period and Missing or Damaged Goods:
Allergy Notice:
Please be aware that Fresh Laundries uses shared washing machines where various detergents are employed. It is possible that traces of prior detergents, which may not be hypoallergenic, could remain in these machines. By voluntarily using Fresh Laundries’ services, including wash, dry, and fold, the Customer acknowledges and assumes the risk of exposure to these residues and any resulting allergic reactions or injuries.
Disclaimer:
FRESH LAUNDRIES’ LIABILITY UNDER THIS AGREEMENT IS LIMITED TO GENERAL MONETARY DAMAGES NOT EXCEEDING THE AMOUNT PAID BY THE CUSTOMER FOR THE SERVICE IN THE PERIOD DURING WHICH THE DAMAGES OCCURRED. THIS LIABILITY SHALL BE THE FULL EXTENT OF FRESH LAUNDRIES’ RESPONSIBILITY REGARDLESS OF THE FORM OF LEGAL OR EQUITABLE ACTION BROUGHT. THIS SHALL CONSTITUTE THE CUSTOMER’S EXCLUSIVE REMEDY. UNDER NO CIRCUMSTANCES WILL FRESH LAUNDRIES BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, INCIDENTAL, OR PUNITIVE DAMAGES, WHETHER OR NOT IT HAD KNOWLEDGE OF THE POSSIBILITY OF SUCH DAMAGES. FRESH LAUNDRIES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, RELATED TO THE SERVICES PROVIDED UNDER THIS AGREEMENT.
Entire Agreement / Choice of Law:
This agreement, along with any documents referenced within, constitutes the complete and exclusive agreement between the parties. It cannot be modified except in writing, signed by both parties, and shall be governed by the laws of the state in which the services are provided.
